Palmetto Lawn Services SC, LLC - Agreement (1/3)

All lawn estimates are valid for 30 days.  

After the 31st day, estimates will need to be recalculated due to possible changes in materials, delivery and labor costs.  

For lawn projects other than mowing, core aeration or dethatching, if there are changes with the original lawn service project a PALMETTO LAWN SERVICES, SC LLC employee will need to complete an on-site estimate at the rate of $50.00 per visit.

LAWN MOWING / GRASS CUT

Weekly, Bi-Weekly, & One-Time Cut - Lawn Mowing Service: 

1. Mow 

2. Edging along flowerbeds & concrete surfaces.

3. Trimming of perimeter of lawn.

4. Blow off grass off common areas.

Mowing Options: 

•  Weekly ***36 mowing services from Mar-Oct***

•  Bi-Weekly ***18 mowing services from Mar-Oct***

•  One Time Cut or a Few Times, just let us know in the quote instructions.

NOTE:  

All of our Lawn Mowing Services weekly, bi-weekly & one-time cut requires a Credit Card on File.  

We charge your Card on file on the day of your grass cut.  

• You can cancel any time prior to your lawn service date. 

• As a courtesy, please give us at least 48 hours in advance notice prior to your grass cut.

FRONT, SIDES & BACKYARD WORK CONDITIONS:

• Area must be clean and clear (i.e. free of animal waste, toys, decorations, lawn ornaments, fence gate should be unlocked, etc. that will hinder our mower) prior to arrival to start job.

• Failure to have an area clean and clear will result in delay in your mowing service and cleanup fees of a minimum of $25.00

• Failure to have your fence gate unlock, the yard will be skipped & a full grass cut rate charge.

• Additional obstacles, etc. will incur additional cost.  

• Mowing Prices may change anytime depending on size of lot, obstacles, etc. 

LONG GRASS POLICY

• In cases where your grass is overgrown (greater than 6 inches), we charge an additional fee. This compensates for the additional time it takes to complete the job. Therefore, we reserve the right to charge up to 2x the original price in cases of overgrown grass, although the charge is often much less.

• In cases where the grass is extremely overgrown (taller than 12 inches), we will get you a custom quote for the completion of the job, as in these cases it often takes much more time and/or specialty equipment.

• This policy ensure that our crew is fairly compensated for the time spent on each job.

CORE AERATION 

Your Lawn needs to be READY for Core Aeration.   Ready means:  

•  Yard is Free of Debris.  (If you need us to clean the debris, let us know - Surcharge fee is according to what needs to be cleaned up).

•  Lawn is Cut at between 1" - 2" height prior to Aerating.  (If you need this service, let us know ahead of time - Surcharge Fee).  

•  Before we get start your Core Aeration service, make sure the soil is moist enough.

• Please water your lawn the day before we arrive unless it rains prior to our scheduled service arrival.

•  For Lawns that have water sprinklers, please mark your sprinkler heads with flags & any other obstacles prior to the day of Aerating.  

• (If you need us to mark your sprinkler heads, let us know ahead of time - There is a Surcharge Fee).

You can cancel any time prior to your lawn service date. 

As a courtesy, please give us at least 48 hours in advance notice prior to your Core Aeration.

DISCLAIMER: 

• We are NOT liable for any sprinkler damage that is not marked.

• We are NOT liable for any cable, internet, electric wiring that are within 6" of ground.  

• Note: Our Aerator Machines will aerate 2" - 5" deep.  It is set at 3".

• If you want the tines to penetrate the soil deeper than 3", please let us know in advance. 

• NOTE:  Core Aeration Services requires a Credit Card on File.  We charge your Card on File on the day of your Service. 

TOP DRESSING

• Top Dressing Options: 

• Topdressing with CarbonizPN (Biochar + Organic Compost) 

• Topdressing with Organic Compost by Cubic Yards 

• Topdressing with Mason Sand + Organic Compost (50/50 or 70/30 or 80/30 mix) for Lawn Leveling

• Topdressing with Sand ONLY ( Mason Sand or USGA approved Sand such as SuperSod Soil 3 Sand Mix)

• Topdressing with products from GolfAgronomics

• Topdressing with McGill Bees Best

 Recommendation to achieve optimal results with your 1st time Soil Amendments:

1.  Soil pH Sample & optional OM (organic material) Sample Test

2.  Core Aerate (N to S and E to W)

2.  Topdressing with Organic Compost 

3.  Fertilize with slow release granular 

4.  Immediately deep water the lawn at least 1" or wait until early morning to water. 

5.  Follow your grass type Lawn Maintenance Calendar

7 DAY ADVANCE NOTICE REQUIRED TO CANCEL LAWN PROJECT SERVICE 

We understand life happens.  

In our desire to be effective and fair to all clients, the following policies are honored:

Minimum of 7 Day advance notice is required when cancelling your scheduled appointment with us. 

• This allows the opportunity for someone else to schedule an appointment.  

• If you cancel your appointment less than 48 hours prior to your reservation, we reserve the right to charge a cancellation fee of $100 on your Credit Card on file. 

• If for any reason, there is a major weather storm on the day of your service, we will not charge the cancellation fee.  

• We will rebook you in accordance with our schedule. 

• No Access Fee:  There is a $25 fee for No access to your property if your privacy gate is locked.

LAWN PROJECTS:  OPTIONAL PAYMENT TERMS:   Soil Amendments, Topdressing, Sod Install

OPTION 1:

50% of Project Total is due at time of Acceptance of an Estimate.   In the event a refund is required before the project has started customers may receive 80% of the deposit back minus the cost of materials purchased.  Remaining Balance is due immediately upon completion of the project unless stated otherwise.  If payment in full is not received by PALMETTO LAWN SERVICES, SC LLC within 3 days of project completion a finance charge of 1.5% compounded each day late and a $50 processing fee will be incurred.   After work has started refunds will not be issued.

OPTION 2:  50% of Project Total Deposit is due at time of Acceptance of this Estimate and remaining balance is billed Monthly on the 1st of each month for 12 consecutive months.

OPTION 3:  50% of Project Total Deposit is due at time of Acceptance of this Estimate and remaining balance is billed Monthly on the 1st of each month for 24 consecutive months.  Both options are available for any renewals of service the for the following year for both Core Aeration and Top Dressing combined and any other add on services such as Top Dressing with Sand and/or Overseeding.

ATTORNEY’S FEES: 

In the event Customer fails to pay as required by this Agreement, PALMETTO LAWN SERVICES, SC LLC shall be entitled to recover from Customer any fees or costs incurred by Palmetto Lawn Services, SC LLC including reasonable actual attorney fees and collection agency fees, in the demand, commencement, and/ or prosecution of collection activities.

GUARANTEE: 

All material is guaranteed to be as specified by supplier.  All work to be completed in a workmanlike manner.  Due to factors beyond our control, PALMETTO LAWN SERVICES, SC LLC does not warranty against materials provided by lawn supply companies to include sod quality & seeds germinating properly as there are multiple factors involved including not watering.

LIMITATIONS OF LIABILITY: 

In the event of delivery beyond curb line PALMETTO LAWN SERVICES, SC LLC will not assume any liability for damages to curbs, sidewalks, driveways, or lawn. Any damage to landscape, sidewalks or driveway by equipment or by delivery truck while gaining access to the jobsite, will be the responsibility of the Customer.  Access to the jobsite is necessary.  PALMETTO LAWN SERVICES, SC LLC is not responsible for soil conditions resulting turf management negligent.  PALMETTO LAWN SERVICES, SC LLC is not responsible for unforeseen or buried items that may be damaged during core aeration of contracted work defined by this proposal. PALMETTO LAWN SERVICES, SC LLC does not guarantee any overseeding will fully make your lawn full and lush.

Palmetto Lawn Services SC, LLC - Agreement (2/3)

LANDSCAPING, TOPDRESSING, CORE AERATION:  

PALMETTO LAWN SERVICES, SC LLC is not responsible for any landscaping, landscape restoration, or for any incidental damage to existing landscaping including trees, shrubs, bushes, flowers, etc. Repair of ruts from equipment, and landscape restoration along edges of flatwork will most likely be needed and is not included (unless listed as an additional item in Estimate). 

PALMETTO LAWN SERVICES, SC LLC does NOT guarantee any top-dressing materials (organic compost, sand, carboniz PN, etc.) that are caused or displaced by weather (rain, hail, hurricane, etc.).

ALTERATIONS: 

Any alterations or deviation from proposed specifications involving extra costs will be executed only upon written orders and will be billed as follows at 7 or more days out from project start date: $100 change order, 2 to 6 days out: $150, 24 hours or less: $200.00.

DELAYS: 

All agreements are contingent upon 811 Dig and/or HOA approvals, weather, accidents, or delays beyond our control. Jobs are scheduled upon receipt of the signed Estimate and Deposit; “first come, first serve”.  Customers will be notified of an approximate start and completion date.  Occasionally, our schedule needs adjusting due to weather, job delays, lack of permits, accidents, employee illness, back ordered material, etc.   In such an event, Customer agrees that such delays do not constitute non-performance and Customer will be notified of their projected start date.

INSURANCE: 

Customer to carry desired homeowners or other insurance.  PALMETTO LAWN SERVICES, SC LLC carries general liability, workers compensation, and commercial insurance.  PALMETTO LAWN SERVICES, SC LLC is licensed and bonded to meet proper requirements in the State of SC.

LIEN WAIVERS/ CONTRACTS PROVIDED: 

Customer acknowledges receipt of a copy of the Agreement prior to the commencement of any work or any payment hereunder, and is hereby informed that Customer is entitled to receive lien waivers from all contractors, subcontractors, and material suppliers at or prior to the time final payment is made.

LIEN NOTICE: NOTICE OF LIEN RIGHTS: AS REQUIRED BY THE [SC] CONSTRUCTION LIEN LAW, PALMETTO LAWN SERVICES, SC LLC HEREBY NOTIFIES OWNER THAT PERSONS OR COMPANIES FURNISHING LABOR OR MATERIALS FOR THE PROJECT ON OWNER’S LAND MAY HAVE LIEN RIGHTS ON OWNER’S LAND AND BUILDINGS IF NOT PAID. THOSE ENTITLED TO LIEN RIGHTS IN ADDITION TO PALMETTO LAWN SERVICES, SC LLC ARE THOSE WHO CONTRACT DIRECTLY WITH THE OWNER, OR THOSE WHO GIVE THE OWNER NOTICE WITHIN SIXTY (60) DAYS AFTER THEY FIRST FURNISH LABOR OR MATERIALS FOR THE LAWN PROJECT. ACCORDINGLY, OWNER PROBABLY WILL RECEIVE NOTICES FROM THOSE WHO FURNISH LABOR AND MATERIALS FOR THE LAWN PROJECT AND SHOULD GIVE A COPY OF EACH NOTICE RECEIVED TO THE MORTGAGE LENDER, IF ANY (SUCH SIXTY-DAY NOTICES ARE NOT REQUIRED UNDER CERTAIN CIRCUMSTANCES). PALMETTO LAWN SERVICES, SC LLC AGREES TO COOPERATE WITH THE OWNER AND THE OWNER’S LENDER, IF ANY, TO SEE THAT ALL POTENTIAL LIEN CLAIMANTS ARE DULY PAID.

CUSTOMER RESPONSIBILITY: 

• It is the Customer's responsibility to ensure the proposed work is within property lines.   

• Customers must obtain any necessary approvals and permits including prior to projected job start date.   

• Homeowners will contact 811 a minimum of 7 days prior to the start date if there is a concern that internet, cable, electric, etc. lines are buried within 6 inches from the topsoil surface.

Palmetto Lawn Services SC, LLC - Agreement 3/3 

We recommend you follow your grass type's Lawn Maintenance Calendar after your initial services with us to optimize results. 

CORE AERATION MAINTENANCE:  

• We recommend watering your lawn immediately after the service is complete. This will assist in dissolving the core plugs.

• We recommend to topdress and fertilize your lawn same day and/or immediately after core aeration.

• DIY:  Topdress with  CarbonProG as a topdressing if you did not choose this as an option when core aeration service was completed. 

• DIY:  Fertilize with Granular Slow Release like a NPK 15-0-15 (Centipede Homeowners) as a fertilizer if you did not choose this as an option when core aeration service was completed.

• If your soil is compacted, we recommend annually to Core Aerate your lawn yearly as part of yearly maintenance to remove excess moss, thatch, relieve soil compaction, and to improve drainage and airflow.

TOP DRESSING MAINTENANCE:  

• We recommend after your initial lawn service, for you to DIY - top dress with Mirimichi CarbonPro G or Mirimichi CarbonizPN-G monthly during growing season to increases soil’s water retention, improves the overall soil structure, stimulates microbial activity, breaks down thatch, and neutralizes the soil’s pH. It is simply the best, natural, slow-releasing soil amendment, containing everything turf needs to thrive.

• Yearly: 

• Immediately after Core Aeration, spread 1 bag of CarbonPro G or CarbonizPN-G per 1k sq ft.  

• Then, spread 1 bag per 8k sq ft every 4-6 weeks, repeat the process yearly during growing season

• Soil pH test every Jan until desired soil pH has been reached, then Soil pH sample test every 2 years thereafter.

OVERSEEDING MAINTENANCE: 

• Depending on conditions and type of seed, new grass seed will begin to emerge in 5-14days after seeding when moisture and soil temperatures are adequate. 

• An overseeded lawn can be fully established in eight weeks or less.

• Proper watering is critical to successful overseeding. The following is a recommended watering program.

• Immediately after overseeding:  Water to wash grass seeds into slits.

• Until grass seeds germinate (first 10-21 days): Water lightly on a daily basis, soaking first one inch of soil, keeping soil moist 2-3x daily.

• After germination:  Water less frequently but allow for deeper soaking and penetration into soil. This encourages deeper root growth.

AFTER SOD INSTALLATION

• After SOD is installed, at this point, repeat these mantras: "mow as soon as there is something to mow" and "water, water, water" 

• We recommend you follow your Grass type's Lawn Maintenance Calendar after your initial services with us to optimize results.
